After much debate, I chose to take the following approach with respect to images of Brandy posted in this site's photo gallery:

My aim in posting images is to celebrate Brandy's beauty and to share that with my visitors.  This site is an entirely non-commercial endeavour.  I do not make a penny from operating it; in fact, operating it costs me money as well as time.  In this spirit, I have chosen to put up whatever images are most representative, which I have access to, irrespective of how they were obtained.

This decision was partly based on the observation that virtually every fan site in existence incorporates images for which publication rights were not obtained; were I to strictly avoid doing as every other site does, I would have a needlessly inferior site.

Instead, I will share what I physically can inasfar as doing so does not generate complaints from copyright holders.  In order to reasonably satisfy the interests of copyright holders, I will: 1. credit the photographer wherever this information is known to me; 2. refrain from posting images in an excessively high resolution; 3. preserve watermarks and copyright notices in images having such markings as obtained (within mechanically-imposed resolution constraints); and 4. remove images upon request by their copyright holders.

To my visitors:

Most or all of the images in this photo gallery are not in the public domain.  I do not claim ownership in any of these images (unless otherwise indicated in the photo credit).  If you wish to use any of these images in a commercial capacity, you must obtain permission from the copyright owner.  I have indicated who the owner is alongside the picture, whenever I know this.  (I am not officially representing that even non-commercial use is acceptable, though in practice, it is probably not a large concern.)

To copyright holders or their legal representatives:

In some cases, the source from which I have obtained an image did not indicate the photographer or copyright owner.  In these cases, I have indicated the credit as being “unknown”.  If you are the photographer or copyright owner of such an image, or of an image for which my indication of the credit is not correct, please contact me and I will correct the credit.

If you own the rights to an image in this gallery and wish to have the image removed from it, please contact me and I will remove the offending image.

To webmasters of other fan sites:

If I have included any images in this gallery that were obtained directly through your Brandy site, I have already included your site in my links section as a courtesy.

A number of fan sites apparently have a policy of inserting watermarks and/or decals in photos they present.  I do not do this myself, as it could be misconstrued as a claim of copyright ownership.

While I would have no legal obligation to preserve such markings, I have chosen to leave them intact (subject to mechanically-imposed resolution constraints), both as a courtesy to those sites and because it is easier to leave them than remove them.

If a fansite webmaster requests that an image obtained from their site be removed from this gallery, I will honour that request if the webmaster can provide reasonable evidence that they own copyright title or exclusive license to the image in question.  To clarify, scanning an image from a magazine or downloading it from a stock site does not grant you copyright title or exclusive license to that image.

Should a fansite webmaster (if unable to prove legal interest in a photograph) absolutely insist, I will, upon request, remove their decals from an offending image, as such markings would constitute the extent of their ownership in such image.  Of course, leaving the markings in is free advertising for their site, so I consider it unlikely that anyone will make such a request.

To Brandy:

It is my aim to portray you in a positive light and in a manner that would please you.  Therefore, I will, at your request, remove any content you wish.  (Please do give me some way to know that the request is genuinely from you.)

To anyone else who appears in these photographs:

It is my hope that you do not mind appearing in this gallery alongside Brandy.  If, however, you do wish to be removed, please contact me and I will do so.  I might ask for some evidence that you are in fact the person depicted.

Please note that I only post images that have been published elsewhere in some capacity, and so you will need to address more than just your inclusion on this site in order to entirely avoid being published.
